Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the NextScenario website, products and services (the “Service”). By creating an account, accessing the Service or visiting nextscenario.com you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who we are
The Service is operated by NextScenario (“NextScenario”, “we”, “our”), a company incorporated under the laws of Spain. You can reach us at hello@nextscenario.com.
2. Eligibility and accounts
You must be at least 18 years old and able to enter into a legally binding contract to use the Service. You are responsible for keeping your account credentials confidential and for all activity that happens under your account. Notify us immediately of any unauthorised use.
3. The Service
NextScenario provides a financial-analytics platform that connects banks, ERPs and sales channels to deliver cashflow, P&L and operating-metric reports. We may add, change or remove features at any time. We will give reasonable notice of changes that materially reduce functionality you actively use.
4. Acceptable use
You agree not to: (a) use the Service in violation of any applicable law; (b) reverse-engineer or attempt to extract source code; (c) interfere with the integrity or performance of the Service; (d) use the Service to send unsolicited communications; or (e) upload data you do not have the right to share.
5. Customer data and privacy
You retain ownership of the data you connect to or upload through the Service (“Customer Data”). You grant us a limited licence to process Customer Data solely to provide the Service to you and to improve it in aggregated, anonymised form. Our handling of personal data is governed by our Privacy Policy, which forms part of these Terms.
6. Fees and billing
Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except where required by law. We may change plan pricing on at least 30 days’ notice; any change applies to the next renewal cycle. Late payments may result in suspension of the Service.
7. Trial and free tier
If we offer a free trial or free tier, the Service is provided as-is for that period and we may withdraw access at any time and for any reason. At the end of a trial, paid features will not be available unless you upgrade.
8. Third-party connections
The Service integrates with third-party providers (banks, accounting tools, payment processors, advertising platforms). Your use of those providers is governed by their own terms. We are not responsible for outages, errors or policy changes by third parties.
9. Confidentiality
Each party will protect the other’s confidential information using at least the same care it uses for its own confidential information, and at minimum reasonable care. Customer Data is treated as your confidential information.
10. Intellectual property
NextScenario, the platform software, the website, the logo and all related materials are owned by us and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
11. Warranty disclaimer
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that the figures it displays are suitable for any specific decision.
12. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or related to these Terms or the Service is limited to the amount you paid to us in the 12 months immediately preceding the event giving rise to the claim. Neither party is liable for indirect, incidental, special or consequential damages, or loss of profits, revenue or data.
13. Termination
You may stop using the Service and cancel your account at any time. We may suspend or terminate your access for material breach of these Terms or for non-payment, on reasonable notice where practicable. Upon termination, your licence to use the Service ends; we will keep Customer Data available for export for 30 days.
14. Changes to these Terms
We may update these Terms from time to time. The latest version is always at this URL. Material changes will be notified by email or in-app notice. Your continued use of the Service after the effective date constitutes acceptance of the new Terms.
15. Governing law and disputes
These Terms are governed by the laws of Spain, without regard to its conflict-of-law provisions. The courts of the city of NextScenario’s registered office have exclusive jurisdiction, except where mandatory consumer-protection law gives the consumer a right to sue in their place of residence.
